Personal data includes all information that relates to you as an individual or which can lead to your identification. 2.    Personal data, type and purposes of processing, legal basis

If you access our website and view its contents, then we collect and process only the following personal data, which your browser transmits to us:

  • Your CV, information about your former employers, certificates and other documents of your choice that are relevant for the application.

If the provision of your personal data is required under a contract or for the conclusion of a contract (including job applications), then the failure to provide data of some types may have the consequence that a contract (including an employment contract) cannot be concluded with you, or that the contract with you cannot be fulfilled by Captrain, or that services cannot be provided by Captrain.

If we transmit personal data to processors, we will carefully choose these, and instruct and monitor them in accordance with valid rules for this area. A current list of the processors we use and additional information can be requested under the e-mail address given above.

The collection and processing of your personal data is lawful

  • In accordance with Article 6 (1) (a) GDPR, provided that we have obtained consent from you for the processing for one or more specific purposes.
  • In accordance with Article 6 (1) (b) GDPR, if processing is necessary for the performance of a contract to which you are party, or in order to take steps at your request prior to your entering into a contract.
  • In accordance with Article 6 (1) (c) GDPR, processing is necessary for compliance with legal obligations of Captrain (e.g. an obligation to store information).
  • In accordance with Article 6 (1) (f) GDPR, to the extent that the processing is necessary for the purposes of legitimate interests pursued by Captrain or by a third party. Legitimate interests of Captrain are in particular the functioning of IT systems of Captrain, the marketing of products and services of Captrain and the legally required documentation of commercial contacts.

3.    Cookies

When you visit our website, cookies will be stored on your computer if you have activated this function on your computer. Cookies are text files by means of which we receive information about which pages and contents on our website have been accessed via your browser. The information serves to make our website more user-friendly and is also used for the analysis of the use of our website, either by ourselves or by third parties (evaluation of the use of the website, reports about website activities, the provision of services for Captrain on the basis of the analysis). We view this as a legitimate interest in accordance with Article 6 (1) (f) GDPR both for Captrain as well as third parties.

Our websites used Google Analytics, a web analysis service of Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA (“Google”), which also makes use of cookies. The use involves “Universal Analytics”. This makes it possible to allocate data, sessions and interactions to a pseudonymised user ID across various devices, and in this way to analyse the activities of a user across devices. To this end, data may be transferred to a server in the United States of America for processing there. There is no European Commission adequacy decision for the USA in accordance with Article 45 (1) GDPR. However, Google Inc. is certified in accordance with the EU U.S. Privacy Shield, so that transfer is permissible in accordance with Article 46 (2) (f) GDPR (Implementing Decision (EU) 2016/1250 of the European Commission of 12 July 2016).

Sessions and campaigns are terminated after a certain period of time. As default, sessions are ended after 30 minutes without activity and campaigns after six months. After withdrawal, your personal data may still be processed where this is permissible on another legal basis apart from consent, e.g. for the fulfilment of a contract, for legitimate interests, or another legal obligation of our company.

5.    Place and duration of storage, automatic erasure

We will only store your personal data until the purpose for which it was collected has been fulfilled. We will only store the personal data collected when you visit our website as long as it is needed to identify you as visitor. Your personal data will then be erased automatically.

6.    Your rights

You are entitled to demand without charge information, corrections, erasure or restrictions on processing of your personal data and of their transmission.
